A person whose claim is merely derived from the mortgagor generally cannot defeat the summary possession process by simply challenging the foreclosure. However, a genuine third party asserting an independent right adverse to the mortgagor may require the court to examine evidence, potentially forcing the purchaser to pursue an ordinary action for possession.
